Can an individual entrepreneur be involved in import or export?

Yes, he can.

It all depends on which group of the single tax and the sale of which goods the sole proprietor is going to deal with. Since:

– The first group has the right to sell only at retail, then foreign economic activity is closed for it.

– The second group can sell all goods except prohibited ones.

– The third can sell both goods and services, and engage in both import and export.

To start foreign economic activity, a sole proprietor must be accredited at customs, conclude a contract, identify a partner in declaring (representing his interests in customs authorities), and prepare the entire list of documents for import or export operations. How to pay less taxes?

Since we are all law-abiding citizens and enterprises with you, and we pay taxes only in accordance with the law, there are only two answers:

Maximally display all costly transactions related to economic activities in the company’s accounting department (for example, you use a private car when you go to meetings related to business – in this case, you need to draw up a car rental agreement between you and your company, and you will have the opportunity to write off for fuel costs and car repairs), etc.
Can I pay at a restaurant at the expense of the enterprise, meeting a delegation of my partners from abroad, if they have this level of the norm in the country for business?

Sure you can. The question is more of whether you can take a restaurant bill for expenses and whether this will entail additional taxes. If this is related to the economic activities of the company (for example, in order to agree with the client on cooperation, you need to hold a meeting in a restaurant), then with correctly drawn up documents after such a meeting, such a calculation will be considered the costs of the enterprise.

What is needed for starting foreign economic activity?

Please note that for both import and export operations, the package of documents is very similar, but the list of permits for non-tariff regulation may be completely different.

What is non-tariff regulation, you ask? – we will be happy to answer on a customs broker’s consultation or share a step-by-step checklist of actions for the start of foreign economic activity.

In general terms, you need to follow these steps:

  1. signing of a correctly drawn up foreign economic agreement;
  2. opening foreign currency accounts in the bank;
  3. registration of a foreign economic agreement with a bank;
  4. accreditation at customs and signing an agreement with the right customs brokers, with high experience in defending customs value, since this will be your first transaction in the context of this participant in foreign economic activity.
What is the terrible word INCOTERMS I heard, is it needed for export or import?

Incoterms are international rules recognized by government authorities, legal companies and merchants around the world as the interpretation of the most commonly used terms in international trade. The scope of Incoterms applies to the rights and obligations of the parties under the contract of sale (contract) in terms of the supply of goods (terms of delivery of goods).

The contract is governed by two important conditions – these are the terms of delivery and the terms of payment.

Can I accept foreign exchange payments to FOP from my counterparties-partners, or register a TOV right away?

Yes, ypu can.

If you are engaged in foreign economic activity, you have a foreign currency account with a bank and an agreement or invoice has been approved, then you can accept foreign currency payments and you do not need to register a TOV.

Can an employee be paid less than the minimum wage?

Such cases do occur. For example, an employee works part-time. But let’s say right away that the inspecting authorities immediately pay attention to this and ask for additional clarification why this is so. If we talk about a cleaning lady who cleans your office once a week, it is better to employ her under a civil law contract.

What is VAT?

VAT is a value added tax that is calculated as 1/6 of the value added.

(For example, you bought a product for 100 UAH. Sold for 120 UAH. VAT payable to the state = 20/6 = 3 UAH 33 kopecks.)

The most difficult thing for Ukrainian entrepreneurs is the issue of VAT administration, registration of tax invoices, export VAT, VAT refunds on export, but these are already questions for more than one accounting consultation.

What is income tax?

This is a tax that is calculated as 18% of the company’s financial result for a certain period. It is paid either quarterly or once a year. We hope that in the near future it will be replaced by a tax on withdrawn capital.

If the money was transferred to me in January, and I pay some tax for it, but there is no income in February, there is no income in March, will I pay taxes in February and March for January money that is in my account?

The timing of the payment of taxes and the basis for their calculation varies depending on the selected group of the single tax. For example, if this is the second group, then regardless of whether the money came to you or not, you must pay a monthly fixed payment, and if this is the third group, then you must pay tax, depending on the arrival of money for the quarter, within the time limits set by the law.
