Terms of delivery or Incoterms in normal-people speak: what is Incoterms?
Incoterms 2020 – international rules that apply in international trade to determine the rights and obligations of the parties in terms of delivering goods from the seller to the buyer in accordance with the sales contract. Please note that it is important not to confuse definitions such as payment terms and delivery terms.
What are the key differences between Incoterms 2010 and 2020?
  • Title of one of the delivery terms has been changed. DAT term has been renamed to DPU delivery terms.
  • The FCA delivery terms have been changed and now provide for two possible places of shipment by the seller of the goods:
  • For the seller, delivery is considered complete when the goods are physically loaded onto the vehicle specified by the buyer.
  • For the seller, delivery is considered complete when the goods are delivered to the place specified in the contract.
  • Changes have been made to the conditions of cargo insurance, which follow on the terms of CIF and CIP. The terms of Incoterms 2010 foresaw that the seller had to insure the goods for a minimum amount. According to the terms of Incoterms 2020, the seller is obliged to insure the goods against all risks with the maximum insurance coverage and the insured amount of at least 110% of the value of the goods. Also, the parties can agree on a lower level of insurance in the contract.
  • In the terms of delivery of Incoterms 2020, the party that is responsible for customs clearance and customs formalities at the border is described in more detail, and assumes the costs and risks.
Is Incoterms 2010 still valid?
Incoterms 2010 continues to be in effect today and is legally binding – the main thing is to prescribe in the contract in which edition Incoterms is adopted, and indicate the terms of delivery that correspond to this edition.
What are the delivery terms?
There are 11 conditions for cargo delivery, 7 of which are applicable to any type of transport: EXW, FCA, CPT, CIP, DAT, DAP, DDP and 4 are applicable exclusively to maritime transport and transport of territorial waters:FAS, FOB, CFR, CIF. Incoterms (International commercial terms) are international rules that provide unambiguous interpretation of the most widely used trade terms in the field of foreign economic trade, regarding the place of transfer of liability-risks from the seller to the buyer, which is the standard terms of the international sale and purchase agreement developed by the International Chamber of Commerce.
What are delivery terms groups and how to understand them E F C D?
Group E– shipment, transfer of obligations – at the place of departure. The seller is obliged to provide the goods to the buyer directly at the manufacturing plant, in his warehouse; customs clearance of goods, registration of permits by the seller is not performed; the seller is not responsible for loading the goods onto the vehicle; EXW. Group F – the main carriage is not paid for by the seller, the seller undertakes to deliver the goods to a point previously agreed with the buyer, where the goods will be transferred to the disposal of the carrier, which the buyer hires on his own;FCA, FAS, FOB. Group C – the main carriage is paid by the seller, the seller pays for the delivery of goods, but without assuming the risk of accidental loss of goods or damage to the goods; transfer of obligations – at the arrival terminals for the main transportation; CFR, CIF, CPT, CIP. Group D – arrival, transfer of obligations at the buyer's side, full delivery. The seller bears all shipping costs and assumes all risks until the goods are delivered to the destination country;DAT, DAP, DDP.
What are the delivery terms?
Incoterms 2010 defines 11 terms, 7 of them are applicable to any mode of transport of the main transportation:
  • EXW (ex-warehouse, ex-works): the buyer takes the goods from the seller's warehouse specified in the contract; payment of export duties, loading and unloading operations, registration of permits for non-tariff regulation, customs clearance of goods, repackaging of goods for the possibility of transportation is the responsibility of the buyer (and is included in the cost of goods during customs clearance, for which customs payments are charged).
  • FCA (free carrier): the goods are delivered to the main carrier of the customer at the terminal of departure specified in the contract, the seller pays the export duties.
  • CPT (carriage paid to...): the goods are delivered to the main carrier of the customer, the seller pays the main carriage to the arrival terminal specified in the contract, the buyer pays for insurance costs, import customs clearance and delivery from the arrival terminal of the main carrier is carried out by the buyer.
  • CIP (carriage and insurance paid to...): the same as CPT, but the main carriage is insured by the seller.
  • DAT (delivered at terminal): delivery to the import customs terminal specified in the contract has been paid for – that is, export payments and the main carriage, including insurance, are paid by the seller; import customs clearance is carried out by the buyer.
  • DAP (delivered at place): delivery to the destination specified in the contract; import duties and local taxes are the responsibility of the buyer.
  • DDP (delivered duty paid): the goods are delivered to the customer at the destination specified in the contract, cleared of all customs duties and risks.
  • Also, Incoterms-2010 defines 4 terms that are applicable exclusively to sea transport and transport of territorial waters:
  • FAS (free alongside ship): the goods are delivered to the buyer's ship, the port of loading is indicated in the contract; transshipment and loading is paid by the buyer.
  • FOB (free on board): the goods are shipped to the buyer's ship, the seller pays for transshipment.
  • CFR (cost and freight): the goods are delivered to the buyer's port of destination specified in the contract, the buyer pays for insurance of the main carriage, unloading and transshipment.
  • CIF (Cost, Insurance and Freight): the same as CFR, but the seller insures the main carriage.
What documents are required for exporting an animal abroad?
Documents for exporting animals abroad:
  1. Electronic identification.
  2. Veterinary passport.
  3. Rabies vaccinations.
  4. Certificate of a blood test for titration of antibodies to the rabies virus.
  5. Form 1 VET, 1 VET (CIS), veterinary certificate
And also when crossing the border, the customs inspector will involve an inspector of the veterinary service for registration, to whom you will need to provide all the above documents for animals in order to obtain permission from other services.
What documents are required to cross the border by car?
To cross the border by car, you need: a foreign passport, a technical passport for the car with a mandatory record that you are the owner of the car. If the car is not registered to you, in this case, you must have a power of attorney with the inscribed phrase "with the right to travel abroad".
How much money can be transferred across the border?
According to the Resolution of the NBU, it is allowed to import and export without declaring an amount that does not exceed the equivalent of 10 thousand euros. If the amount of cash currency and bank metals is equal to or exceeds the equivalent of 10 thousand euros, then a written declaration to the customs authority in full is required. In this case, you need to have documents confirming the withdrawal of cash from your own bank accounts, and receipts for the implementation of a currency exchange operation with this cash (if such an operation is carried out) exclusively for that amount exceeding the equivalent of 10 thousand euros.
What happens if I do not declare something when crossing the border?
For undeclared goods that move across the customs border of Ukraine, the Customs Code provides for punishment in the form of a fine in the amount of 100% of the value of these goods, as well as confiscation of goods. Also, if you move goods with concealment from customs control, this entails the imposition of a fine in the amount of 100% of the value of these goods, as well as the confiscation of such goods and vehicles with special caches.

Property must be declared in order to avoid any incidents at customs, for example, confiscation of property, avoidance of fines and registration of a protocol regarding violation of customs rules.
I would like to transport a family book or painting, how can I do it?
If a painting, a book made more than 50 years ago – regardless of its value, it is subject to customs declaration. You also need to register the ownership of these items, conduct a state examination of the item, obtain a certificate for the right to export the item. If you believe that the item is not a cultural value, but there is reason to believe that complications may arise during the passage of customs control, then you must obtain a certificate from the Office for Control over the Movement of Cultural Property and Cultural Heritage that the cultural property is not a cultural value.
I am immigrating, how do I ship my cargo to the country?
The set of documents required for customs clearance of cargo depends on the nature of the goods. Certain goods require a specific set of accompanying documents.
What is accompanying baggage, how to check it out?
Accompanying baggage is baggage that belongs to citizens and moves across the customs border in the baggage compartments of vehicles on which citizens are traveling. By the Customs Code, Art. 345, a list of goods is foreseen that may relate to personal belongings; goods are also allowed for export, the total invoice value of which does not exceed 10 thousand euros. It is allowed to import goods, the total invoice value of which does not exceed 1 thousand euros, which are imported by citizens into the customs territory of Ukraine in hand luggage through checkpoints open for air connection, as well as goods worth the equivalent of 500 euros for no more than 50 kg through all other checkpoints. This baggage is non-declared and is moved through the green corridor. If, however, you are moving a quantity that exceeds the above norms, then you should move your luggage through the red corridor; at the same time, you will be asked to fill out a declaration of the established form for citizens.
